What are some good ways to conduct a group mediation?
I have a group working under me that is not getting along at all. They have been having issues building up for a year or so and now we are holding a mediation session to resolve these issues. Does anyone have any suggestions on an effective way for everyone to get their thoughts heard without pointing fingers? I want this to be productive and for the people in the mediation to not walk out upset or defeated.
You have to keep everyone calm. Find out what it is that makes the people upset towards each other and fix it. If this does not work take your conflicting groups and separate them into two separate teams.
What happens during the mediation process of an auto injury claim?
Auto accident. Injuries and filed suit. Depositions. Now an appointment for mediation prior to trial date. What happens during this process?
Both sides agree on a mediator.
Then they meet – starts in the same room. Each side says a little about their case.
Then they are separated. The mediator goes from one room to the other between the two parties. The mediator is trying to point out the weakness in each side’s case and get them to agree on a settlement figure.
Each side pays their own cost and 1/2 of the mediator.
Usually the mediator is another attorney or retired judge. It’s not uncommon for an attorney who has had a long and distinguished career to retire and just act as a mediator.
How to separate mediation issues from arbitration issues?
My divorce agreement says the ex and I must "mediate" if there’s a dispute. Yes, there are several disputes. But my ex keeps saying we need "arbitration". There are some issues for which I’d like mediation and keep some decision power, and some issues I’d agree for an arbitrator to decide for us. HOW do I make sure the issues stay separated during mediation/arbitration?
mediate…. arbitration….. when you get right down to it…. they are basically the same.
How to write a letter to the other parent requesting we attend mediation?
I need a mediator to help the other parent and I resolve specific issues, such as him denying my parenting time for no reason at all, he keeps my kids from talking to me and me contacting them, and he has not been following the parenting plan. So, I have to get him to come to mediation and I need to address this to him in writing so I need to put a appropriate and professional letter together to suggest mediation and for him to sign and check mark which day works best for him and to send it back to me & the mediator. Any suggestions?

What can you tell me about mediation as a career?
A certification course is available to me. What is the pay for professional certified mediators? Are they self-employed or, if not, who employs them? Is it easier to find employment in large cities, or are jobs available in rural / small town areas? What is the difference between mediation and conflict resolution?
I plan to work in Texas.
Mediation is a type of conflict resolution (also called alternative dispute resolution).
In California, most mediators started their careers as attorneys. A lot of them were also judges.
I don’t think certification matters as much as experience. You may have to volunteer to do a few mediations (for free) to get experience if you want to mediate in the legal field.
If you mean family law mediation, that may be different.
It depends on the type of mediation you want to do.
